Wolters Kluwer has recently released the second edition of the book “Antibody Patenting. A Practitioner’s Guide to Drafting, Prosecution, and Enforcement.” The book is an updated and expanded version of the one that was published in 2019 (about which we previously wrote here) and covers issues concerning the patentability of antibody inventions in more than 30 of the world’s most important intellectual property jurisdictions.
Juan Arias, our managing partner and co-founder, signs the chapter on Spain, which he wrote with the collaboration of Gemma Muruáis, a European Patent Attorney in our Biotechnology & Life Sciences department. In addition to addressing certain technical issues, this update includes a reference to infringement by equivalence and the Catnic/Improver test, an approach used primarily in biotechnology and chemistry patent litigation to determine whether patent infringement occurs when the allegedly infringing object/process has technical elements equivalent to those defined in the patent claims.
Dr. Jürgen Meier and Oswin Riddersbuch, both members of the AIPPI Biotechnology Committee and well-known patent attorneys in Germany and the rest of Europe, prepared this new edition of the book and managed a total of 49 contributors.
